Terms and conditions of sale

1.    All orders are accepted subject to our standard Conditions of Sale reproduced below. In these conditions “the company” means Wolff & Grace Ltd, “the Customer” means the person named as Customer on the Company’s estimate or invoice. 

“Goods” means the goods or any of them described in the Company’s invoice or estimate as provided to the Customer.

“Contract” means the contract for the sale by the Company to the Customer of the goods constituted by these terms and including the Company’s Estimate or Invoice.

2.    The Customer must ensure that all measurements supplied to the Company are correct and accurate in all respects. The Company shall not be liable to the Customer for any losses that may arise due to measurements given to its personnel by the Customer, which are later found to be incorrect and/or inaccurate.

3.    Prices given at the time of purchase are estimates only and may be subject to revision if further works are required.

4.    A 50% deposit must be paid at the time the Goods are ordered with the balance payable prior to installation. All payments must be fully cleared prior to delivery, collection or installation. In the event that the Goods are not collected or installed within 3 months and unless otherwise agreed the Company reserves the right to cancel the order.

5.    Where an order is cancelled pursuant to point 4 above and unless otherwise agreed the Company may, without prejudice to any other right or remedy sell the Goods at the best price readily obtainable and retain the deposit or any part thereof to cover any shortfall below the price under the Contract.

6.    VAT is charged at the applicable rate at the time an estimate is given. The Company reserves the right to amend this in accordance with any applicable changes in VAT rates.

7.    Estimates are given based on information supplied by the Customer and on the assumption that the work is to be carried out in accordance with the Customers instructions at that time. Any later variation to the Customer’s instructions may effect the original estimate. In the event that this leads to an increase in the original estimate, the Customer will be advised of the increase and will be responsible for paying the revised charge.

8.    The Company will endeavor to install the ordered goods on the date specified in the Contract.

9.    Any refund due to the Customer will be paid by cheque or credited back to their credit card if applicable

10.The Company reserves its title to the goods until all sums due from the Customer have been paid in full. If the Customer sells the Goods in such a manner as to pass a valid title to a third party the Customer shall hold the proceeds of such sale on trust for the Company.

11.An estimate does not normally allow for removal of furniture etc. Unless otherwise agreed. All sites should be clear and floor dust free prior to installation.

12.The Company will not undertake the uplifting or disposal of existing flooring unless agreed at time of order/installation.

13.The Company will not be responsible for moving gas and electrical appliances and equipment. The Customer must arrange this if required prior to installation.

14.To ensure satisfactory installation, wiring and cables must not be placed under the floor covering and the Company does not recommend installation of floor covering over any wiring or cables. The Company will only lay the floor covering over wiring and cables at the customer’s specific request and entirely at the Customer’s own risk.

15.The Company does not make allowance for the shifting of close fitted stair carpet. Hall, stairs and landings are often planned from broadloom widths for reasons of overall economy and this often involves the stairs being fitted in two or more pieces.

16.The Customer must ensure that he/she or a representative of theirs is present at the premises when the Goods are being installed.

17.The Company shall not be liable to the Customer for any faulty installation by the Customer.

18.The Company will supply the Customer with instructions concerning the proper care and maintenance of the Goods.

19.A signature is required for all deliveries/installations of Goods.

20.Often the walls of a room in which the floor covering (especially patterns and ribbed) are to be installed are out of true straight alignment. The Customer must establish this prior to Order and where this is the case the Company will with the agreement of the Customer install the floor covering to fit the floor in line with the straightest wall.
